Terms and Agreements for The Phoenix Path Advanced Somatic Practitioner Training

1. Introduction

Welcome to The Phoenix Path. This document outlines the Terms and Agreements for participation in the course. By enrolling, you agree to adhere to these terms.

2. Course Participation

2.1 Eligibility
Participants must be at least 18 years old and demonstrate a commitment to personal growth and group work facilitation.

2.2 Conduct
Participants are expected to maintain a supportive environment, demonstrating respect and integrity towards all members.

2.3 Confidentiality
All personal information shared within the course is confidential. Participants agree not to disclose any information shared by others outside the course.

3. Payment and Refund Policy

3.1 Fees
Course fees are due in full upon registration unless a payment plan is arranged.

3.2 Refunds
Refunds are available within 14 days of registration, provided no course materials have been accessed. After this period, no refunds will be issued.

4. Course Materials

4.1 Access and Usage
Participants will receive access to all necessary course materials. These materials are for personal use only and cannot be shared or distributed without permission.

4.2 Intellectual Property
All course content, including videos, texts, and other resources, remain the intellectual property of The Phoenix Path. Unauthorized use or distribution is prohibited.

5. Liability

5.1 Personal Responsibility
Participants are responsible for their own physical, emotional, and mental well-being. The course facilitators are not liable for any personal outcomes resulting from participation.

5.2 Disclaimer
The Phoenix Path is designed for educational purposes and is not a substitute for professional medical, psychological, or legal advice. Participants should seek professional support as needed.

6. Termination of Participation

6.1 Grounds for Termination
The Phoenix Path reserves the right to terminate a participant's involvement in the course for violations of these terms, including but not limited to disruptive behavior, breach of confidentiality, or non-payment of fees.

6.2 Procedure
Participants will be notified of any issues and given an opportunity to address them before termination of participation is enacted.

7. Amendments

The Phoenix Path reserves the right to amend these terms at any time. Participants will be notified of any changes and are encouraged to review the terms periodically.

By enrolling in The Phoenix Path, you acknowledge that you have read, understood, and agree to these Terms and Agreements.

 

Terms and Agreement for 12-Month Phoenix Path Payment Plan

1. Introduction

This agreement outlines the terms and conditions for the 12-month payment plan for the Phoenix Path program provided by Jessica Benstock.

2. Payment Plan

  • Total Program Fee: $10,000
  • Payment Schedule: Monthly installments of $835 for 12 months.
  • Payment Method: Payments will be automatically charged to the provided payment method on the same day each month.

3. Payment Terms

  • Initial Payment: The first installment of $835 is due upon enrollment.
  • Subsequent Payments: Each subsequent payment of $835 will be automatically deducted on the same date of each month as the initial payment.
  • Late Payments: Late payments will incur a late fee of $50. If payment is not received within 7 days of the due date, access to the program may be suspended until the account is brought current.

4. Cancellation and Refunds

  • Cancellation Policy: You may cancel your enrollment within 14 days of the initial payment for a full refund. After 14 days, no refunds will be provided.
  • Program Withdrawal: If you choose to withdraw from the program after 14 days, you are still responsible for the remaining payments on the plan.
  • Program Termination: Jessica Benstock reserves the right to terminate your enrollment if you fail to comply with the program guidelines or if payments are consistently late.

5. Access to Program Materials

  • Material Availability: Upon receipt of each payment, you will receive access to the next module of the Phoenix Path program.
  • Completion of Payments: Full access to all program materials and any applicable certifications will be granted upon the completion of all 12 payments.

6. Confidentiality and Intellectual Property

  • Confidentiality: You agree to keep all program materials and discussions confidential.
  • Intellectual Property: All materials provided in the program are the intellectual property of Jessica Benstock and are for your personal use only. You may not distribute, copy, or share these materials without written permission.

7. Dispute Resolution

  • Arbitration: Any disputes arising from this agreement will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
  • Governing Law: This agreement shall be governed by and construed in accordance with the laws of the state of Colorado.

8. Acceptance of Terms

By enrolling in the Phoenix Path program and selecting the 12-month payment plan, you agree to these terms and conditions. Your acceptance of this agreement is indicated by your electronic signature or payment submission.

9. Program Inclusions

  • Description of Services: The Phoenix Path program includes access to 12 monthly modules, bi-weekly group coaching sessions, one-on-one mentorship sessions, and all associated resources and materials.
  • Additional Costs: Participants might incur additional costs such as materials for specific exercises, event fees, or travel expenses for any optional in-person sessions.

10. Participant Responsibilities

  • Engagement: Participants are expected to actively engage and participate in all sessions and activities.
  • Conduct: Participants must adhere to appropriate behavior and conduct during sessions and within any online communities or forums related to the program.

11. Technology Requirements

  • Access: Participants must have access to a reliable internet connection and any necessary software or hardware to participate in the program.

12. Privacy Policy

  • Data Protection: Participant data will be collected, used, stored, and protected in accordance with our privacy policy.
  • Communication: By enrolling, you consent to receive communications related to the program.

13. Modification of Terms

  • Updates to Terms: These terms may be updated or modified as necessary. Participants will be informed of any changes to the terms of this agreement.

14. Force Majeure

  • Unforeseen Circumstances: Jessica Benstock is not liable for any delays or disruptions in the program due to unforeseen events such as natural disasters, pandemics, or other circumstances beyond our control.

15. Indemnification

  • Liability: Participants agree to indemnify and hold harmless Jessica Benstock from any claims, damages, liabilities, or expenses arising out of their participation in the program.

16. Severability

  • Clause Validity: If any part of this agreement is found to be invalid or unenforceable, the remaining provisions will continue to be in effect.
